These general conditions of sale are agreed between the company YOURFITEQUIPMENT LDA, headquartered at Rua da Indústria, nº 76 4760-758, VN Famalicão with tax identification number 516 238 256 and contact +351 252 080 647, hereinafter referred to as “YOURFIT EQUIPMENT ” and people who wish to make purchases through the website www.yourfitequipment.com called "User".

OBJECT:
- The purpose of these General Terms and Conditions of use is to define the conditions for accessing and browsing the website by the customer who wishes to make purchases in the online store. The General Sales Conditions aim to regulate the operational terms of commercial transactions carried out between YOURFIT® and the Client.
- The Privacy Policy aims to identify the measures to protect privacy with regard to the processing of personal data and the free circulation of personal data, including tools for personalized management of personal data provided by customers.

GENERAL CONDITIONS OF SALE: Ordering and Purchase Process.
- Deadline and Payment Methods: After completing the order process in the customer account, the customer has a deadline (24 hours), selecting the payment method, to proceed with the payment of the same. After this period the order will be cancelled.
- YOURFIT® offers the following payment methods for purchases made in the online store:
- Credit Card: Customers can pay by credit card and enjoy the advantages of liquidity and payment terms offered by their bank. All transactions on our website are secure.
- ATM: Payments by ATM can be made through the ATM network or through your Homebanking. When finalizing your order, an ATM reference will be generated. The customer will receive this reference in the order confirmation email. To make payment at an ATM, the customer must select the option "Payment of Services/Purchases" and enter the corresponding entity, reference and value.
- If, after 24 hours, the customer has not carried out the transfer, the order will be cancelled.

- YOURFIT® is committed to protecting the customer's data and these will never be made available to third parties without the knowledge or consent of the owner, as legally required.
- When processing the customer's order, it is possible that certain personal data (such as address and postal code) are disclosed to third parties for the sole purpose of preventing and detecting fraud and always following a request for this purpose by the competent authorities. In addition, when you make a purchase on the website, you will also be asked for data relating to the delivery address and payment details, in order to ensure the greatest possible efficiency and compliance with delivery deadlines.
- The data provided will be kept for the strictly necessary period, which normally corresponds to the period of existence of the customer account. For this reason, when the customer triggers the cancellation of the customer's account, the personal data will be permanently deleted, with the exception of the data necessary to comply with legal obligations, which will be filed in a specific database for this purpose and for absolutely no time. required. RETURN CONDITIONS:
- Return of defective products: The customer is entitled to a return if it is verified that the supplied products have defects or other non-conformities in relation to the ordered items.
- The defect must be communicated within a maximum period of 48 hours after receiving the product to the email info@yourfitequipment.com.
- The customer must attach photographs/videos in the e-mail that prove the non-conformity of the packaging/product.
- The return can be made within 15 days after notification of the defect against the presentation of the original invoice and the product must keep all original elements.
- The seller will analyze the returned product and inform the user of the right to a refund (if applicable), or exchange for the same or another product at the customer's option (taking into account that any exchange for a valuable item higher, the customer will have to pay the difference).
- As a general rule, the seller proceeds with the refund within 15 working days from the date of confirmation via e-mail of the right to refund.
- For returns and exchanges, the customer must request it via email info@yourfitequipment.com.
- If the defect or non-conformity is confirmed as justification for the return, the entire amount paid will be refunded. Refund of the amount paid will be made by bank transfer. These provisions do not affect your statutory rights.

THE RIGHT TO RETURN ONLY OCCURS PROVIDED THAT THE PRODUCTS:
- Have not been washed or used (unless the product contains information to the contrary). The customer has the right to try the equipment and accessories but cannot use them.
- Keep the original characteristics and the packaging is not damaged (carefully opened packaging will not be considered damaged).
- Are complete (eg both items of a pair must be returned).
- Have not been tampered with and keep the identification label, if the product has this label.
- All items that are manufactured by customization are not returnable.

RETURN FOR WITHDRAWAL:
- If the customer is not satisfied with the products supplied, the customer may return them within 15 calendar days after receipt, against presentation of the original invoice. As a rule, the seller proceeds with the refund within 15 working days from the date of confirmation via e-mail of the right to refund. The right to return only occurs, provided that the products:
- Have not been washed or used (unless the product contains information to the contrary). The customer has the right to try the equipment and accessories, but cannot use them.
- Keep the original characteristics and the packaging is not damaged (carefully opened packaging will not be considered damaged).

RETURN OF OFFERS:
- The return of an offered product must be made by the person who offered/purchased it, with presentation of the original invoice.
- If the defect or non-conformity is confirmed as justification for the return, the entire amount paid will be refunded. The refund will be made to the debit or credit card used to make the purchase or by bank transfer.

EXCHANGE FOR SIZE OR OTHER ITEMS:
- To exchange an item for another item, it is necessary to request the exchange through the email info@yourfitequipment.com.
- An item can only be exchanged for another of equal or greater value and products can only be exchanged once. If after the exchange order you are not satisfied, you can only return your order and place a new order.
- The customer is responsible for returning and shipping the returned goods. The return must be accompanied by the original invoice.
The right to exchange only occurs, provided that the products:

SHIPPING & CARRIERS:
- We deliver orders from Monday to Friday. Shipments are not made on certain holidays (you can get confirmation by sending an email to info@yourfitequipment.com).
- We guarantee the delivery of an order to the requested address, whether it is a home or a place of work and no deliveries are made to PO Boxes.
- The preparation and shipment of the order from the warehouse may take up to 2 working days (5 working days for large orders) after payment confirmation.
- COVID-19 NOTICE: Estimated time for order preparation and dispatch is currently 2-5 business days.
- After shipment, delivery time varies by location and carrier.
SHIPPING COSTS:
Shipping charges are automatically calculated by our system and depend on the following factors:
- Actual weight of the order;
- Carriers' tariffs, which are periodically updated;
- Customer shipping address.

TRANSPORT TIMES:
- YOURFIT®, works in partnership with carriers so that the following shipping times can be ensured. However, these may vary for reasons beyond YOURFIT®,.
- Mainland Portugal: 2 working days (5 working days for large orders)
- Islands (Azores/Madeira): Between 5 to 8 working days.
- Spain: 3 working days (5/7 working days for large orders).
- Germany, Austria, Belgium, France, Netherlands, Italy, Luxembourg, United Kingdom weekly shipments on Friday delivery within 7/10 working days.
- Denmark, Finland, Ireland, Norway, Sweden, Switzerland: weekly shipments on Friday delivery within 7/10 working days.
- Bulgaria, Slovakia, Slovenia, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Romania: weekly shipments on Friday delivery within 7/10 working days.

Christmas and New Year:
- In order to ensure that you receive your order before the 25th of December, it must be placed and paid by 15:00 on the 20th of December for deliveries in Portugal and Spain. Until December 8th for deliveries in France. For deliveries outside this area, orders must be placed and paid by 15:00 on December 7th.
- Orders placed between the 25th of December and the 3rd of January may be delayed.
